Does DOT Drug Testing Test for Kratom? 49 CFR Part 40 Guide for CDL Drivers

Commercial truck drivers (CDL holders), airline employees, railroad crews, transit operators, maritime personnel, and pipeline workers are subject to some of the strictest workplace drug testing rules in the United States. If you work in a safety-sensitive transportation role, you need a clear, regulation-backed answer: does a DOT drug test check for kratom?

Under federal regulation 49 CFR Part 40, the answer is no. Not only is kratom (mitragynine) absent from the federal Department of Transportation drug panel, but federal regulations actually prohibit laboratories from testing a DOT specimen for any additional substances outside the five federally mandated classes.

Does a DOT drug test screen for kratom under 49 CFR Part 40?

No. All DOT-mandated pre-employment, random, post-accident, reasonable-suspicion, and return-to-duty drug screens are governed by Title 49 of the Code of Federal Regulations, Part 40 (49 CFR Part 40), enforced across FMCSA, FAA, FRA, FTA, PHMSA, and USCG. Under 49 CFR § 40.82 (formerly § 40.85), a DOT drug test is strictly limited to five specific drug categories:

  1. Marijuana metabolites (THC)
  2. Cocaine metabolites (Benzoylecgonine)
  3. Amphetamines (amphetamine, methamphetamine, MDMA, MDA)
  4. Opioids (codeine, morphine, 6-acetylmorphine, hydrocodone, hydromorphone, oxycodone, oxymorphone)
  5. Phencyclidine (PCP)
  6. Even more importantly, 49 CFR § 40.13(c) explicitly states that employers and laboratories must not perform any additional testing on a DOT urine or oral fluid specimen for any other substance. A collector or laboratory cannot legally "tack on" a mitragynine test to your federal DOT sample.

What is the difference between a federal DOT test and a company non-DOT test?

While a federal DOT specimen cannot be tested for anything beyond the five 49 CFR Part 40 classes, commercial drivers and transportation workers should understand one key workplace distinction: DOT vs. non-DOT company testing.

    • Federal DOT Specimen: Collected using a Federal Drug Testing Custody and Control Form (CCF). Strictly limited by law to the 5 DOT classes above. Never screens for mitragynine.
    • Employer Non-DOT Specimen: Some large trucking carriers or logistics companies maintain a separate internal "company policy" program (such as a non-DOT hair test or an expanded non-DOT urine cup) that requires a completely separate specimen collection and non-federal custody form. Even on standard 10-panel or 12-panel non-DOT employer screens, mitragynine is not included unless the employer orders a specialized custom forensic panel. See our complete 5-Panel & 10-Panel Drug Test Guide for details.

Does the FMCSA Drug and Alcohol Clearinghouse track kratom?

No. The FMCSA Commercial Driver's License Drug and Alcohol Clearinghouse only records violations of the federal DOT drug and alcohol testing program under 49 CFR Part 40 and Part 382 (such as a verified positive result for one of the five DOT drug classes, an alcohol test result of 0.04 or higher, or a refusal to test). Because kratom is not a scheduled substance under the Controlled Substances Act and is not part of 49 CFR Part 40 testing, it is not a reportable substance in the FMCSA Clearinghouse.

Additionally, Commercial Drivers should keep state-by-state legality in mind when planning routes across state lines. While kratom is federally legal across the United States, seven states currently restrict possession or sale. Check our State Shipping & Legality Guide before traveling with kratom products.

Why do CDL drivers and safety-sensitive workers check batch COAs before buying?

For anyone whose livelihood depends on a clean DOT record, buying unlabelled or gas-station kratom products is an unnecessary gamble. Adulterated products or unverified synthetic blends lack quality control and can introduce undisclosed substances. At CRYO Kratom, every product batch is verified by independent third-party laboratories and published on our Lab Results (COA) page so you can verify exact alkaloid potency and purity before you buy:

How can you compare portable formats and save on bulk orders?

Whether you prefer measured tablets or pre-sealed liquid shots, you can compare every format on our Product Comparison page, try two formats together in CRYO Bundles, or order larger counts on 3M Tablets Bulk (10 to 1,000 tablets) with free U.S. shipping on orders of $75 or more. If you also hold a federal clearance, read our Kratom and Security Clearance Guide.

Retailers and truck-stop distributors: CRYO manufactures and imports its own kratom extracts with full batch COA documentation. Visit kratom wholesale, wholesale kratom shots, or kratom manufacturer to open a commercial account.
